Details for NOTICE Pursuant to the “Noncoal Surface Mining Conservation and reclamation


Pursuant to the “Noncoal Surface Mining Conservation and reclamation Act” and the “Clean Streams Law” notice is hereby given that Duffy, Inc., PO Box 374, 1 Delta Drive, Smethport, PA 16749-0374 has made application to the Pennsylvania Department of Environmental Protection (DEP) for a permit to conduct noncoal surface mining activities in Roulette Township, Potter County.

The application includes a request for authorization to discharge under an individual NPDES permit.

The application includes a request to conduct blasting.

The application includes a request for a variance to utilize a portion of the existing lane/proposed haul road which lies within 100' of an unnamed tributary to the Allegheny River just south of the roadway crossing of the UGI gas line. This 340' section of stream channel has minimal flows partially sourced by groundwater which then disappears at the lower end of the channel. At the closest point the existing roadway lies within approximately 45' of the stream channel. The only improvements proposed to the existing roadway within 100' of the unnamed tributary would be the placement of rock on the roadway surface to provide stabilization and prevent sediment runoff.

The proposed permit area is 175.0 acres and is situated north of PA Route 6, northeast of Roulette, southeast of Fishing Creek Road, and northwest of Trout Brook Road on the Jonathan E. Huff, Charles A. Hepler, Dana W. Halle, and Jeffrey Molishus, et al properties.

The receiving streams for the proposed permit area are an unnamed tributary to the Allegheny River (CWF) to the Allegheny River (CWF), and Fishing Creek (CWF) to the Allegheny River (CWF).

The Roulette, PA., U.S. Geological Survey 7.5 minute topographic map contains the area described. A copy of the application is available for public inspection at the Potter County Conservation District, 107 Market Street, Coudersport, PA 16915.
